We are committed to protecting the privacy and security of your information. This Privacy Policy is integrated into our Terms & Conditions of Use (“Terms & Conditions”).

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we may use or disclose your information. By accessing or using our website and/or services, you consent to the use of information that is collected, submitted, used, or shared as described in this Privacy Policy and corresponding Terms & Conditions. If you do not agree with our policies and practices, it is your choice to not use our Services.

We will provide notice to you if any updates are material and, where required by applicable law, obtain your consent. This Privacy Policy applies to users of websites and other online platforms, all digital assets contained or offered therein (collectively, “Websites”), mobile messaging programs (“Messaging Program”), and any offline activities (collectively, our “Services”) provided by Margaritaville Restaurants and Landshark Bar & Grill locations operated and maintained by IMCMV. This Privacy Policy describes, among other things, the types of information we collect from users when you use our Services, how we use it, and how you can access your information. This Privacy Policy also informs you about certain choices and rights you may have associated with your information and how you can manage the privacy of your information. We take our obligations regarding your privacy seriously and worked to draft this Privacy Policy in a manner that is clear and easy for you to understand.

We may collect certain categories of information about you, described in more detail below, which include the following: (A) information you provide to us, (B) information we may automatically collect, (C) information collected by cookies and technology, and (D) information we may receive from third parties. To the extent that this information includes “Personal Information” or “Personal Data,” as defined by applicable law, this information is collectively referred to as “Information” under this Privacy Policy. Information includes any information relating to an identified or identifiable natural person, who could be identified either directly or indirectly by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

In using IMCMV Services, you may provide us with Information, including without limitation, one or more of the following:  

  • Individual Identifiers:  includes your name, username, and date of birth. 
  • Contact Information: includes your mailing address, phone number, and email address.
  • Payment and Transactional Information:  includes your payment and transactional information including Services purchased. Note that we use third party payment processors to facilitate your payments and do not store your payment information.
  • Usage and Technical Information:  includes features that gather information about how users use our Websites. This assists us with keeping track of preferences, creating a more tailored user experience, and better serving users’ particular interests and needs. This information may include IP addresses, Website pages viewed and the duration, browser or operating system information, mobile device type, system settings, and aggregate and/or deidentified data related to a person’s interaction with our Websites.

  • Geolocation data: includes data related to your visit(s) to a particular restaurant or bar that documents or reveals you visited that particular location, such as to collect loyalty program points.

When required by applicable law, IMCMV will collect consent, prior to processing certain categories of sensitive information.

Our Services may automatically collect certain categories of usage and technical Information about you. This Information is used by IMCMV for operation of its Services and provide general statistics regarding use of those Services. Categories of Information we may collect include one or more of the following:

  • Internet Activity:  includes your IP address (the number associated with the service through which you access the internet, including your ISP (internet service provider); date and time of your visit or use of our Services; domain server from which you are using our Services; type of computer, web browsers, search engines, operating systems, and/or platforms you use; data identifying the web pages you visited prior to and after visiting our Websites; your movement and activity within the Websites (aggregated with other Information).
  • Mobile Device Information:  includes the type of device you use, operating system version, and device identifier (“UDID”).

We and/or certain service providers operating on our behalf may collect information about your activity, or activity on devices associated with you over time, on our Website and applications, and across non-affiliated websites or online applications.   • Cookies (or browser cookies): Cookies are small files placed on the hard drive of users’ computers, used to track users’ usage of our Websites and help us make our Websites more informative and user-friendly. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Services. We may also use reCAPTCHA, a tool which utilizes advanced risk analysis techniques to distinguish humans and bots in order to help us protect our websites from fraud, spam, and abuse.   • Third Party Service Providers: We may disclose your Information to third party service providers engaged by IMCMV to facilitate perform tasks, services, and functions on IMCMV’s behalf (such as to host or develop web Services, manage databases, provide technical services, perform analyses, process credit card payments, provide customer services – including shipping and delivery services, display interest-based advertising, and send communications). These third-party service providers are authorized to use your Information only as necessary to provide these services to us. Any such companies must agree to maintain the confidentiality of any information we may provide to them and are contractually obligated not to disclose or use it for any other purpose. Such companies may also collect information directly from you in connection with providing their services, and they will have the right to provide that information to us. For purposes of this Privacy Policy, “sell,” “sold,” or “sale” means the disclosure of Information for monetary or other valuable consideration but does not include, for example, the transfer of Information as an asset that is part of a merger, bankruptcy, or other disposition of all or any portion of our business. “Sharing” means disclosing or making available Information to a third-party for purposes of cross-context behavioral or targeted advertising. While we do not disclose information to third parties in exchange for monetary compensation, we disclose identifiers and Internet and network activity information to third-party advertising networks and analytics providers for purposes of marketing and advertising, and to improve and measure our ad campaigns. Such disclosures may be considered “sales” or “sharing” of Information under applicable laws. We do not sell or share sensitive Information, nor do we sell or share Information about individuals we know are under the age of sixteen (16) years old.

We do not collect, use, or disclose sensitive Information beyond the purposes authorized by the applicable law. We are not responsible for the privacy and security practices of third-party websites, platforms, or the Information they may collect. Instead, such information practices are governed by those entities’ privacy policies. VI. How Your Information is Stored, Transferred, and Secured

IMCMV’s offices are located in the United States, our Services are not directed to clients in other jurisdictions, and we do not host any Information pertaining to clients outside of the United States.

11. Retention and Deletion of Information

We will retain your Information for as long as necessary to provide our Services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of Information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused Information at the earliest reasonable time. Under applicable regulations, we will keep records containing client information, account opening documents, communications, and anything else as required by applicable laws and regulations. We will not retain your Information or sensitive Information longer than reasonably necessary for the purposes for which the Information was collected. We may rectify or remove incomplete or inaccurate information, at any time and at our own discretion. We are under no obligation to store Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Information.

IMCMV takes the privacy and security of your Information seriously, and uses reasonable, appropriate, and customary procedures and technologies to help protect the confidentiality of any information we collect. IMCMV employs reasonable administrative, physical, and technical safeguards to protect the Information we collect, process, and store. However, no website, network, or system can be absolutely protected against intentional or malicious intrusion attempts despite taking appropriate and reasonable precautions. Therefore, as is the case with any organization, we are not able to guarantee the absolute security of your Information. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. 

The safety and security of your information also depends on you. IMCMV does not control the devices, computer, or network through which you access the Websites or over which you may choose to send Information to us, and therefore, IMCMV cannot prevent potential interceptions or compromises to your Information while in transit. IMCMV makes no guarantee as to the security, integrity or confidentiality of any information transmitted to or from the Websites, and any transmission of Information is at your own risk. You agree that we will not have any liability for misuse, access, acquisition, deletion, or disclosure of your Information.

If you do not want to receive marketing and promotional emails from us, you may click on the “unsubscribe” link in the email to unsubscribe and opt-out of marketing email communications or contact us via email or telephone at the contact information listed in the Contact Us section. 

Text Messages 

You may sign up to receive text messages from IMCMV or third-party service providers on behalf of IMCMV (e.g., text message marketing). By using our Website and/or Services, signing up for text messaging services, or otherwise opting in to receive text messages (opting in via short code or entering your phone number into an on-site collection widget), you agree that you have provided IMCMV or its third-party service providers with prior express written consent to be contacted by text message, including recurring automated promotional and personalized marketing text messages.

By providing prior express and/or prior express written consent, you agree to receive text messages under the Telephone Consumer Protection Act and other federal or state laws, including by the use of an automatic telephone dialing system (“ATDS”), to deliver text messages to the mobile phone number you provided to IMCMV. While you consent to receive messages sent using an ATDS (or “autodialer”), the foregoing shall not be interpreted to suggest or imply that any or all of IMCMV mobile messages are sent using an autodialer. Your consent is not a condition of any purchase or use of our services and your consent to be contacted as described is voluntary. 17. “Do Not Track” Signals 

We do not support “Do Not Track.”  Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the “Preferences” or “Settings” page of your web browser. Do Not Track is different from Global Privacy Controls (“GPC”), which may notify websites of consumers’ privacy preferences regarding the sale or sharing of Information, or the use of sensitive Information.

We cannot control third parties’ responses to do-not-track signals or other such mechanisms. Third parties’ use of data relating to you and responsiveness to do-not-track signals is governed by their respective privacy policies.

18. Children’s Privacy

All of our Services, including our Websites, are intended for adult audiences, and are not directed to or meant for individuals under the age of 18 (“Children”). As such, we do not knowingly collect information from anyone under the age of 18, and Children under 18 may not use our Sites or any other Services. If you are under 18, do not attempt to register for or use any of our Services, including our Websites, and do not provide us any information about yourself. We may collect information pertaining to Children under 18 only if provided by a parent or guardian in the course of adding the Child as a dependent with regard to the Services. 

If you are a parent or guardian and you are aware that your child has violated this Privacy Policy and provided us with information, please contact us. If we become aware that we have collected information from Children without verification of parental consent, we will take steps to remove that information from our systems.

19. Notice of Financial Incentive

The IMCMV Dining Rewards Program (“Program”) is a voluntary loyalty program. You can opt-in to the Program by registering for an account online or in one of our restaurants or signing up through our Websites, and you may opt-out at any time. 

To opt-out of the Program, contact us at any time by emailing your Dining Rewards registered email, phone number and name to [email protected]. Cancellation of this Program will void all rewards and points previously earned. Please note that if you request deletion of part or all your information, that could also affect your ability to qualify for rewards offered through the Program.

You may receive a financial incentive in the form of an email coupon, discount, rebate, free sample, promotions, or other similar reward that will be sent to you. The categories of Information required for us to provide the financial incentives include identifiers such as full name and contact information including email address, purchase history, and other demographic information you choose to provide. In order to provide you with the rewards described above, IMCMV will use the Information you provide to us including your name, username, email address, phone number, mailing address, date of birth, and purchase history to provide you with the rewards described above, facilitate your membership in the Program, and communicate with you to provide information you request or other information relevant to your membership.

The rewards that we provide to Program members are reasonably related to the value of the data you provide to us. While we do not calculate the monetary value of the data that you provide, it is valuable to us because it allows us to further our relationship with you, to understand your preferences based on your purchasing history so that we can suggest offers that will be useful to you, and reward and thank our loyal customers for patronizing our business. Any value varies depending on the purchases each Program member makes, the rewards they take advantage of, and many other factors. 20. Surveys, Sweepstakes, Contests, & Promotions

From time-to-time, we may offer sweepstakes, contests, and other promotions (any, a “Promotion”) that may require registration. Participation in these surveys or contests is completely voluntary and you may choose whether to participate and therefore disclose this information. By participating in a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, your Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion’s official rules, such as on a winner’s list.
